1. Introduction
These Terms of Service govern your use of SkillmaxX Academy's website, courses, workshops, training programs, learning resources, events, assessments, certificates, mentoring, and related services.
By accessing our website, submitting an enquiry, registering for a course, making a payment, attending a class, using our learning materials, or participating in any SkillmaxX Academy program, you agree to these Terms.
If you do not agree with these Terms, please do not use our website, register for a course, or access our services.
2. About SkillmaxX Academy
SkillmaxX Academy provides education and training programs focused on AI, productivity, data analysis, automation, full-stack development, coding with AI, business automation, and future-ready skills.
Our courses may include, among others:
- AI for Office Productivity
- AI-First Data Analyst Program
- AI Business Automation Specialist
- Full-Stack AI App Development
- AI tools, automation, RAG, coding agents, data, dashboards, and related programs
- Short workshops, bootcamps, seminars, webinars, and custom corporate training
Courses may be delivered offline, online, hybrid, live, recorded, self-paced, project-based, or in a blended format.
3. Eligibility
You may use our services if you are legally capable of entering into a binding agreement.
If you are under 18 years of age, your registration, payment, and participation should be made with the consent and involvement of a parent, guardian, school, college, or authorised institution.
For advanced courses, certain prerequisites may apply. It is your responsibility to read the course description and clarify doubts before enrolling.
4. Course Information
We aim to keep course descriptions, curriculum, duration, tools, schedules, fees, outcomes, and other information accurate and updated.
However, SkillmaxX Academy may revise, update, replace, or improve course content, tools, projects, assignments, instructors, schedules, platforms, or delivery methods from time to time to keep courses relevant and practical.
Any examples, case studies, projects, tools, software, or technologies mentioned in a course may change based on availability, pricing, licensing, relevance, or industry updates.
5. Registration and Admission
Registration may be completed through our website, forms, WhatsApp, phone, email, offline admission process, payment link, invoice, or other approved channel.
Your seat in a batch is confirmed only after:
- Required registration details are submitted
- Applicable fees are paid or an approved payment plan is accepted
- SkillmaxX Academy confirms your enrollment
Seats may be limited and are offered on a first-come, first-served basis unless otherwise stated.
SkillmaxX Academy reserves the right to reject, cancel, or defer admission where information is incomplete, payment is not received, eligibility is not met, or misuse/fraud is suspected.
6. Fees, Payments, and Taxes
Course fees will be communicated through the website, brochure, invoice, admission counsellor, WhatsApp, email, or official quotation.
Fees may vary based on:
- Course type
- Batch format
- Duration
- Offline or online delivery
- Offers or scholarships
- Corporate or institutional training requirements
- Add-ons such as recordings, certificates, mentoring, projects, or placement/career support
Unless otherwise stated, fees are payable in Indian Rupees.
Applicable taxes, including GST, may be charged where required.
Payment may be accepted through UPI, bank transfer, payment gateway, card, wallet, cash, cheque, or other approved mode. Payments are subject to successful confirmation by our payment provider or bank.
Any payment gateway charges, bank charges, financing charges, EMI charges, or third-party processing charges may be governed by the relevant provider's terms.
7. Instalments and Payment Plans
If SkillmaxX Academy allows instalment payments or a payment plan, you agree to pay each instalment on or before the due date.
Failure to pay an instalment may result in:
- Suspension of class access
- Suspension of recordings, LMS access, or project review
- Delay in certificate issuance
- Removal from batch or course
- Recovery of outstanding amounts
Course completion, certificate issuance, career support, and continued access may be subject to full payment of all dues.
8. Refund Policy
We want learners to make informed decisions before enrolling. Please review the course details, duration, schedule, prerequisites, fees, refund terms, and expected outcomes before making payment.
8.1 Instructor-Led Live Courses
For live online, offline, or hybrid instructor-led courses, a refund request may be considered only if all the following conditions are met:
- The refund request is made within 7 days of payment or before attending the second live session, whichever is earlier.
- The learner has not attended more than one live class.
- The learner has not accessed, downloaded, copied, or substantially used course recordings, premium learning resources, templates, project files, or restricted course material.
- The learner has not received a certificate, completion record, exam voucher, software license, kit, or other non-refundable benefit.
- The request is sent in writing to info@skillmaxx.org.
8.2 Self-Paced / Recorded / Digital Courses
For self-paced, recorded, or digital-access courses, a refund request may be considered only if:
- The request is made within 7 days of payment.
- Less than 25% of the course content has been accessed or consumed.
- No certificate, downloadable premium resource, project pack, software key, voucher, or other non-refundable benefit has been issued.
- The request is sent in writing to info@skillmaxx.org.
8.3 Short Workshops, Webinars, and Events
For short workshops, masterclasses, webinars, bootcamps, or one-day/two-day events, fees are generally non-refundable once the event has started.
If you cannot attend, you may request a transfer to another eligible participant or a future batch, subject to SkillmaxX Academy's approval, seat availability, and written intimation at least 48 hours before the event.
8.4 Non-Refundable Cases
Refunds will not be provided in the following cases:
- Refund request made after the applicable refund window
- Learner has attended more than the permitted number of sessions
- Learner has consumed substantial course content
- Learner has downloaded or accessed restricted learning material
- Learner fails to attend classes after enrollment
- Learner is removed for misconduct, plagiarism, abuse, fraud, policy violation, or non-payment
- Learner is dissatisfied after the refund window has expired
- Learner expected a job, salary increase, promotion, freelance income, business result, or placement that was not expressly guaranteed in writing
- Third-party tool, software, AI platform, cloud service, or certification provider changes its pricing, terms, access, or availability
- Any course, workshop, or offer was expressly marked as non-refundable at the time of purchase
8.5 Duplicate Payments
If a duplicate payment is received for the same course and learner, we will verify the transaction and process the eligible duplicate amount back to the original payment method or another approved mode.
8.6 Refund Processing Time
Approved refunds are generally processed within 7-10 working days after approval and after receiving any required bank/payment details.
Actual credit time may depend on the bank, UPI provider, payment gateway, or payment method.
SkillmaxX Academy may deduct applicable payment gateway charges, bank charges, taxes already remitted, or administrative charges where legally permitted and clearly applicable.
9. Batch Rescheduling and Cancellation
SkillmaxX Academy may reschedule, postpone, cancel, merge, or change a batch due to low enrollment, instructor unavailability, operational reasons, technical issues, emergencies, public holidays, regulatory restrictions, force majeure events, or other unavoidable circumstances.
If SkillmaxX Academy cancels or materially reschedules a batch before commencement, we may offer one or more of the following options:
- Transfer to another batch
- Credit adjustment toward another course
- Extended access period
- Refund of eligible fees paid for the cancelled batch
If you request a batch change after enrollment, approval will depend on seat availability, timing, course format, and administrative feasibility.
10. Attendance and Participation
Learners are expected to attend classes on time, participate actively, complete assignments, and follow instructor instructions.
SkillmaxX Academy is not responsible for missed classes due to learner absence, internet issues, device problems, travel, health, work commitments, exams, or personal reasons.
Recordings, if provided, are a support resource and not a substitute for live participation unless the course is expressly sold as recorded/self-paced.
11. Certificates
Certificates may be issued only when applicable course requirements are met, such as:
- Minimum attendance
- Assignment completion
- Project submission
- Assessment completion
- Code/project review
- Payment of all dues
- Compliance with academic integrity and conduct requirements
SkillmaxX Academy may withhold, revoke, or refuse certificates in cases of plagiarism, impersonation, non-payment, misconduct, false information, or violation of these Terms.
A SkillmaxX Academy certificate confirms participation or completion of a SkillmaxX Academy program. It does not guarantee employment, salary increase, promotion, admission, visa approval, professional license, or third-party certification.
12. Career Support and Outcome Disclaimer
Some courses may include career guidance, portfolio advice, resume review, interview preparation, project-building support, LinkedIn/GitHub guidance, or job-market orientation.
Unless expressly stated in a signed written agreement, SkillmaxX Academy does not guarantee:
- Job placement
- Internship
- Freelance income
- Salary increase
- Promotion
- Client acquisition
- Business growth
- Exam success
- Interview calls
- Admission into any institution
- Certification from a third-party provider
Learning outcomes depend on your attendance, effort, prior background, practice, project work, communication ability, market conditions, and other factors outside our control.
13. AI Tools, Software, and Third-Party Platforms
Our courses may involve third-party tools, AI platforms, coding tools, automation tools, analytics tools, cloud platforms, SaaS tools, or open-source software.
You agree that:
- Third-party tools are governed by their own terms, privacy policies, pricing, rate limits, and usage rules.
- SkillmaxX Academy is not responsible if a third-party tool changes, becomes paid, stops working, restricts access, changes features, or discontinues services.
- You may need to create accounts on third-party platforms for learning purposes.
- Any paid subscription, API cost, software license, cloud usage, domain, hosting, or third-party certification cost is your responsibility unless expressly included in writing.
- You must not upload confidential, sensitive, personal, client, employer, or proprietary data into AI tools unless you have the right to do so.
- You are responsible for verifying AI-generated output before using it.
14. Academic Integrity
Learners must maintain academic honesty.
You must not:
- Submit someone else's work as your own
- Copy assignments, code, projects, dashboards, reports, or submissions without permission
- Use AI tools to misrepresent your own effort where independent work is required
- Share answers during tests or assessments
- Impersonate another learner
- Manipulate attendance, assessments, or certificates
- Misuse course projects, datasets, credentials, or accounts
- Violate third-party intellectual property rights
SkillmaxX Academy may reject submissions, deny certificates, suspend access, or remove learners for academic misconduct.
15. Acceptable Use
You agree not to use our website, courses, platforms, communities, or resources to:
- Violate any law
- Harass, abuse, threaten, defame, or discriminate against others
- Share offensive, harmful, obscene, hateful, or unlawful content
- Spam, scrape, hack, overload, reverse-engineer, or disrupt systems
- Share malware, malicious code, or harmful files
- Access another learner's or instructor's account
- Record, copy, distribute, or sell course content without permission
- Use SkillmaxX Academy content to train AI models or build competing commercial material without written permission
- Misuse brand names, logos, certificates, or testimonials
16. Intellectual Property
All course content, curriculum, slides, notes, videos, worksheets, templates, assignments, quizzes, recordings, frameworks, code examples, datasets, project briefs, website content, brand elements, and learning materials are owned by SkillmaxX Academy or licensed to SkillmaxX Academy, unless otherwise stated.
Your enrollment gives you a limited, non-transferable, non-exclusive right to use the learning material for your own personal education.
You may not copy, reproduce, record, upload, sell, share, publish, distribute, modify, translate, create derivative works from, or commercially exploit SkillmaxX Academy content without written permission.
Learner projects created by learners remain their own work, but SkillmaxX Academy may use anonymised or consent-based examples for teaching, review, internal quality, or showcase purposes.
17. Recordings and Class Materials
Where class recordings are provided, they are for enrolled learners only.
You must not:
- Download recordings unless expressly allowed
- Share recordings outside the enrolled batch
- Upload recordings to public platforms
- Sell or distribute recordings
- Record live sessions without permission
- Share screenshots containing personal data of other learners
Access to recordings may be time-limited and may expire after the course access period.
18. Community and Communication Channels
SkillmaxX Academy may use WhatsApp groups, email groups, LMS forums, community spaces, Discord/Slack-like channels, or other communication platforms.
You agree to keep communication respectful, relevant, and professional.
SkillmaxX Academy may remove messages, restrict participation, or remove learners from groups for spam, abuse, misinformation, harassment, promotional misuse, or violation of these Terms.
19. Learner Responsibilities
You are responsible for:
- Providing accurate registration information
- Checking course prerequisites before enrolling
- Attending sessions and completing assignments
- Maintaining your own device, internet, software, and accounts
- Keeping login credentials secure
- Paying fees on time
- Respecting instructors and fellow learners
- Following tool/platform terms
- Using AI tools responsibly
- Backing up your project work and files
- Seeking clarification before enrollment if any term is unclear
20. Offline Classroom Rules
For offline classes, learners must follow academy rules, safety instructions, classroom discipline, and reasonable staff directions.
SkillmaxX Academy is not responsible for loss of personal belongings, devices, chargers, bags, or valuables brought to the premises.
Any damage caused to academy property may be charged to the responsible learner.
21. Content Accuracy and Educational Disclaimer
SkillmaxX Academy aims to provide practical, updated, and useful education. However, technology, AI tools, programming frameworks, APIs, software pricing, laws, market practices, and hiring trends change frequently.
We do not guarantee that all course content will remain permanently current, error-free, uninterrupted, or suitable for every individual situation.
Courses are for educational purposes and should not be treated as legal, financial, medical, tax, investment, cybersecurity, or professional advice.
22. Limitation of Liability
To the maximum extent permitted by law, SkillmaxX Academy will not be liable for indirect, incidental, special, consequential, punitive, or business losses, including loss of income, loss of job opportunity, loss of data, loss of profit, loss of business, loss of goodwill, or loss arising from use of AI tools, third-party platforms, or learner misuse.
Our total liability for any claim related to a course shall not exceed the amount actually paid by you to SkillmaxX Academy for that specific course, except where such limitation is not permitted by applicable law.
23. Indemnity
You agree to indemnify and hold SkillmaxX Academy, its owners, instructors, employees, consultants, partners, and representatives harmless from claims, losses, liabilities, damages, costs, or expenses arising from:
- Your breach of these Terms
- Your misuse of course content
- Your violation of law
- Your infringement of third-party rights
- Your misuse of AI tools or third-party platforms
- Your project, code, data, content, or submissions
- Your conduct toward other learners, instructors, or third parties
24. Suspension or Termination
SkillmaxX Academy may suspend or terminate your access to courses, platforms, certificates, communities, or services if you:
- Fail to pay fees
- Provide false information
- Violate these Terms
- Misuse content or systems
- Engage in misconduct or harassment
- Commit plagiarism or impersonation
- Attempt fraud or unauthorised access
- Damage the learning environment for others
Suspension or termination for misconduct does not automatically entitle you to a refund.
25. Privacy
Your use of SkillmaxX Academy services is also governed by our Privacy Policy, which explains how we collect, use, share, and protect personal data.
26. Force Majeure
SkillmaxX Academy will not be responsible for delay or failure caused by events beyond reasonable control, including natural disasters, strikes, internet outages, power failures, platform outages, cyber incidents, epidemics, government restrictions, transport disruptions, instructor emergencies, public-order issues, or other force majeure events.
27. Changes to These Terms
SkillmaxX Academy may update these Terms from time to time. Updated Terms will be posted on our website with a revised effective date.
Your continued use of our website, courses, or services after changes are posted means you accept the updated Terms.
28. Governing Law and Jurisdiction
These Terms are governed by the laws of India.
Subject to applicable consumer protection and statutory rights, courts and competent forums in Gurugram, Haryana, India shall have jurisdiction over disputes relating to these Terms, SkillmaxX Academy courses, payments, services, or website use.
